Privacy Policy for HIIT Studio
Effective Date: March 13, 2026
Capsule Studios ("we," "us," or "our") operates the HIIT Studio application ("App") for Meta Quest devices. We are committed to protecting your privacy and handling your personal information responsibly. This Privacy Policy explains how we collect, use, disclose, protect, and process your information when you use our App. By using HIIT Studio, you agree to the practices described in this policy.
We comply with applicable privacy laws, including but not limited to the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and other relevant regulations. This policy applies solely to information collected through the App and does not cover data handled by Meta Platforms Technologies or third-party services integrated with Meta Quest (please review Meta's Supplemental Meta Platforms Technologies Privacy Policy for details on their practices).
If you have questions or requests regarding your data, contact us at [insert email, e.g., [email protected]].
1. Information We Collect
We collect various types of information to provide, improve, and personalize the App's features, such as guided HIIT workouts, intensity tracking, and VR immersion. We categorize this information as follows:
Personally Identifiable Information (PII)
This includes data that can identify you directly, which we collect when you register or interact with the App:
Account details: Username, email address, password, and date of birth (for age verification).
Profile information: Optional details like profile picture, avatar, bio, or preferences (e.g., workout intensity or exercise types).
Payment information: If in-app purchases are available, we collect billing details (processed securely via third-party payment providers; we do not store full credit card numbers).
Physical and Biometric Data
As a VR HIIT app, we collect data related to your movements and interactions to enhance immersion and provide feedback on exercises:
Movement patterns: Headset and controller positions, orientation, gait, and body poses during sessions (e.g., to detect form in burpees or squats).
Optional health metrics: If you enable integrations (e.g., with wearables), we may collect heart rate, calorie burn estimates, or session duration. This is treated as sensitive health data and only collected with your explicit consent.
We do not collect raw biometric data like eye tracking or facial expressions unless explicitly enabled for app features, and such data is processed on-device where possible to minimize risks.
Non-Personally Identifiable Information
This includes aggregated or anonymized data that does not identify you individually:
Usage data: Session length, frequency of use, completed HIIT routines, and in-app interactions (e.g., selected exercises).
Device and technical data: IP address, device ID, operating system, browser type, headset model, and app version for troubleshooting and optimization.
Location Data
We may collect approximate location information (e.g., from your IP address or device settings) to provide region-specific content, such as language preferences or local time zones for session scheduling. Precise location (e.g., GPS) is not collected unless you opt in for features like outdoor HIIT modes.
Information from Third Parties
We may receive data from Meta Quest integrations, such as your Meta Horizon profile (e.g., avatar or username for social features), or from connected services like fitness trackers. We also use cookies and similar technologies (e.g., beacons) to track app performance and user preferences.
We do not collect information from children under 13 without verifiable parental consent. If we discover such data has been collected, we will delete it promptly.
2. How We Collect Information
Directly from You: When you create an account, set up your profile, or input preferences.
Automatically: Through your use of the App, such as tracking movements via VR sensors or logging sessions.
Indirectly: Via cookies, device logs, or integrations with Meta Quest and third-party services.
3. How We Use Your Information
We use your information for the following purposes:
To provide and personalize the App: Customizing HIIT workouts based on your movements, progress, and preferences (e.g., recommending high-intensity intervals).
To improve the App: Analyzing usage data for bug fixes, feature enhancements, and performance optimization.
For communication: Sending notifications about updates, new workouts, or promotions (you can opt out at any time).
For security and compliance: Detecting fraud, ensuring app integrity, and complying with legal obligations.
For marketing: With your consent, delivering personalized ads or offers related to fitness products.
Health data is used solely to enhance your HIIT experience (e.g., tracking improvements) and is not used for unrelated purposes without consent.
We process data only as described here and in accordance with applicable laws.
4. Sharing Your Information
We do not sell your personal information. We may share data in these limited ways:
With service providers: Third-party vendors (e.g., cloud storage, analytics tools like Google Analytics) that help operate the App, bound by confidentiality agreements.
With Meta Platforms: For app integration, such as sharing abstracted movement data for VR functionality (subject to Meta's policies).
For legal reasons: To comply with laws, respond to subpoenas, or protect rights/safety.
In business transfers: If Capsule Studios is acquired, your data may be transferred as an asset.
Aggregated/anonymized data: Shared with partners for research or marketing without identifying you.
We require third parties to protect your data and use it only for specified purposes.
5. Data Security
We implement reasonable security measures, including encryption (e.g., AES-256 for health data), access controls, and regular audits to protect your information from unauthorized access, loss, or breach. However, no system is completely secure, so we cannot guarantee absolute protection. In case of a breach, we will notify affected users and authorities as required by law.
6. Your Rights and Choices
You have rights regarding your data, including:
Access: Request a copy of your information.
Correction: Update inaccurate data.
Deletion: Request removal of your data (e.g., via email to [email protected]; we will respond within 30 days, subject to legal retention requirements).
Opt-Out: From marketing communications or certain data collection (e.g., disable health integrations in app settings).
Portability: Receive your data in a transferable format.
Consent Withdrawal: For processing based on consent.
For CCPA/GDPR users, you may have additional rights, such as opting out of data sales (we do not sell data). To exercise rights, contact us; we do not discriminate against users for doing so.
7. Children's Privacy
HIIT Studio is not intended for children under 13. We do not knowingly collect data from them without parental consent. For users under 16 (or applicable age), we require verifiable parental consent for sensitive data processing. Parents can review, delete, or refuse further collection via our contact email.
8. International Data Transfers
If you are outside the US, your data may be transferred to and processed in the US or other countries. We use safeguards like Standard Contractual Clauses to ensure adequate protection.
9. Data Retention
We retain data as long as needed for the purposes described (e.g., account data while active) or as required by law. Inactive accounts may be deleted after [insert period, e.g., 2 years]. Health data is retained for [insert, e.g., 1 year] unless you request deletion sooner.
10. Changes to This Policy
We may update this policy to reflect changes in practices or laws. We will notify you via email or in-app notice for material changes and post the updated version with a new effective date.
